Terms Of Service
This Terms of Service Agreement (“Agreement”) governs the provision of pet waste removal and management services (“Services”) by Poop Scoop Master LLC (“we,” “us,” or “the Company”) to the client (“you” or “Client”). By initiating or continuing the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Service and Billing
1.1 Scope of Services and Universal Applicability
Poop Scoop Master LLC provides a comprehensive range of pet waste management solutions (collectively, the “Services”), including: recurring monthly subscriptions for pet waste removal, one-time cleanups, deodorization and sanitization treatments, and commercial services (such as pet waste station installation and maintenance).
These Terms and Conditions govern all Services provided by the Company. While specific details regarding scheduling, scope, and pricing may be detailed in a separate Service Quote or Subscription Confirmation, the clauses related to payment, access, liability, termination, and dispute resolution herein apply universally to all forms of service engagement.
1.2 Payment Terms
All service fees (whether for recurring, one-time, or commercial services) are due on the date specified in your invoice or subscription plan. For recurring services, fees are typically billed monthly in advance. Prompt payment of balances due is required to maintain uninterrupted service. Failure to remit payment within 5 days of the due date may result in the suspension or termination of Services.
1.3 Fee and Promotion Changes
All fees and promotions are subject to change at any time. In the rare event of a rate increase or change to the Service structure, we will notify you ahead of time for approval. Continued use of the Services after receiving notification of the change signifies your agreement to the updated terms and fees.
2. Client Responsibilities and Access
2.1 Safe Access
The Client is solely responsible for maintaining safe, unobstructed access into and out of the designated service area (typically the yard). This includes, but is not limited to:
- Unlocking or providing the necessary means of access (e.g., gate codes, keys).
- Removing heavy snow, ice, or large debris from the immediate service path.
- Ensuring the yard is free of hazards or obstacles (e.g., loose tools, toys, furniture) that could impede or prevent service.
If the Company is unable to perform the scheduled cleanup due to lack of access (e.g., a locked gate, blocked path, or safety concern), you will be charged for that cleanup as the Company has made the trip and allocated the time for the scheduled service.
2.2 Pet Management and Safety
While we love our furry friends, for the safety of our team members, we request that all pets who do not get along with ALL strangers have their access to the service area restricted by the Client while we are performing the Services.
If pets are found within the service area during the scheduled visit, team members have the right to refuse service at their discretion due to safety concerns. If service is refused under these circumstances, the visit will be charged as scheduled.
2.3 Pet Population Notification
The Client agrees to provide immediate notification of any changes in the number of pets residing at the service address. Service fees are based on the number of pets, and failure to notify the Company of an increase may result in an immediate adjustment to the monthly rate and a retrospective charge. This section is primarily applicable to recurring residential services.
2.4 Service Pause (Vacation/Illness)
If your pet(s) will not be using the yard for a certain period (e.g., vacation, illness, etc.) and you do not wish to be charged for an unnecessary visit(s), you must notify the Company at least 3 business days in advance to pause the service. Service pauses will be credited to the following month’s bill depending on the Client’s preference and billing cycle. This section is only applicable to recurring subscription services.
3. Weather, Holidays, and Service Guarantees
3.1 Inclement Weather
We will do our best to maintain the scheduled cleaning visits. However, in the event of inclement weather (e.g., heavy rain, thunderstorms, extreme heat, or excessive snow/ice) that makes it hazardous or impossible to perform the Services, the Company reserves the right to postpone the visit. In this event, we will be responsible for servicing your yard as soon as possible, typically within 1-2 business days, or combining the cleanup with your next scheduled visit, at the Company’s discretion.
3.2 Holidays and Closures
The Company observes all US Bank Holidays. Services will not be performed on these days. If your scheduled service falls on a US Bank Holiday, the Company will reschedule it as soon as possible, often to the next available business day, at the Company’s sole discretion.
3.3 Service Quality
We strive for a thorough cleaning. However, we cannot guarantee removal of waste buried deep in the grass or obscured by debris, standing water, or snow. The Client understands that our Services are provided “as is” and based on the conditions present at the time of the visit.
4. Limitation of Liability and Indemnification
POOP SCOOP MASTER LLC ASSUMES NO LIABILITIES FOR DAMAGES TO YARDS, GATES, PETS, OR OTHER PROPERTIES.
4.1 Release of Liability
The Client releases Poop Scoop Master LLC and its employees/contractors from all liability for any claims, damages, losses, or injuries that may occur while Services are being rendered or as a result of the Services or lack thereof.
4.2 Property Damage
While our team takes reasonable precautions, the Company is not responsible for damages resulting from weak, loose, or improperly installed gates, latches, or fencing, hoses, spigots, landscaping etc. The Client acknowledges the inherent risks associated with our staff entering and exiting the property.
5. Termination of Service
5.1 Termination Right
Either party may terminate this Agreement (and the Services) at any time by providing written notice. Written notice includes communication via email to the Company’s official email address. Please allow up to 3 business days for the processing of any termination request.
5.2 Final Payment and Refunds
Upon termination, any unpaid balances are due in full within 15 days of the termination date. Cancellation of subscription plans within the first month of service is non-refundable. No refunds will be issued for services paid for in advance but not yet rendered, unless termination is initiated by the Company without cause. Poop Scoop Master LLC reserves the right to assess each cancellation on a case by case basis and has the option to provide a credit for any services not rendered.
6. Dispute Resolution and Mandatory Arbitration
6.1 Agreement to Arbitrate
Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Trevose, Pennsylvania, before one neutral arbitrator selected by the Company. The arbitration shall be administered by the American Arbitration Association (AAA) pursuant to its Commercial Arbitration Rules. Judgment on the Award may be entered in any court having jurisdiction.
6.2 Waiver of Class Action and Jury Trial
Both the Client and the Company agree that any arbitration or proceeding shall be limited to the dispute between the Company and the Client individually. The Client and the Company agree that neither will be entitled to join or consolidate claims by or against other clients in court or in arbitration or to otherwise participate in any claim as a class representative, class member, or in a private attorney general capacity. The Client and the Company agree that, by entering into this Agreement, they are each waiving the right to a trial by jury or to participate in a class action.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of laws principles.
By initiating and/or continuing to receive the Services, the Client and Poop Scoop Master LLC agree to all the terms and responsibilities outlined in this Agreement.
